Terms of sale
Last updated: 21 October 2026
This is a translation. In the event of any discrepancy, the French version prevails.
Article 1. Seller
The gauvainparis.com website (the “Site”) is operated by MONTMIRAIL FRERE, a French simplified joint-stock company with a sole shareholder (SASU) with share capital of 2,000 euros, registered with the Paris Trade and Companies Register under number 902 634 054, whose registered office is at 133 rue Saint-Dominique, 75007 Paris, France, EU VAT number FR25902634054, which sells products under the Gauvain Paris brand (“Gauvain Paris”, “we”).
Customer service: hello@gauvainparis.com, phone and WhatsApp +33 4 12 05 85 53, Monday to Friday.
Article 2. Scope
These terms and conditions of sale (the “Terms”) apply to every order placed on the Site by a consumer, meaning an individual buying for non-business purposes. Business purchases (resellers, corporate gifts) are covered by separate terms.
The Terms that apply are those in force on the day of your order. They are available at all times on the Site and you can save or print them. By confirming your order, you acknowledge that you have read and accepted them. In the event of any difference between the French version and a translation, the French version prevails.
Article 3. Products
The essential characteristics of each product (composition, fabric weight, country of manufacture, size guide, care instructions) are shown on its product page. We take great care with our photos; colour shades may nevertheless vary slightly depending on your screen.
Our offers are valid while stocks last. When a product is offered as a pre-order, the planned shipping date is shown on its product page and in your order confirmation.
Article 4. Prices
Prices are shown in the currency of your delivery country. For deliveries within the European Union, they include all taxes. Standard shipping is free, except in the few countries listed in our Shipping Policy (Article 7).
For deliveries to the United States, customs duties and import taxes are included and paid by Gauvain Paris. For other countries outside the European Union, customs duties and local taxes may be charged on delivery by the carrier or customs; they remain payable by you, unless stated otherwise when you order. Details by country are given in our Shipping Policy.
The price charged is the one shown when you confirm your order. In the event of an obvious pricing error (for example a derisory price), we may cancel the order: we will let you know and refund you without delay.
Article 5. Ordering
To order, add products to your basket, enter your contact details and delivery address, choose your payment method, then check the summary (products, sizes, total price) before confirming with the payment button. This confirmation constitutes an order with an obligation to pay.
We then send you a confirmation email summarising your order, with a link to these Terms. We recommend that you keep it.
We may refuse or cancel an order in the event of a previous payment dispute or a serious suspicion of fraud. If a product turns out to be unavailable after you have ordered, we will let you know by email and refund that product without delay, within 14 days at the latest.
Article 6. Payment
Payment is due when you order. Accepted methods: Visa, Mastercard, Maestro and American Express cards, Shop Pay, Apple Pay, PayPal, pay in 3 instalments with Klarna, and some local payment methods depending on your country. The methods available for your order are shown at checkout. Payment in instalments is subject to acceptance by, and the terms of, its provider.
Payments are processed by PCI DSS certified providers. Gauvain Paris never has access to your card numbers.
Article 7. Delivery
Standard shipping is free, with no minimum order, to most of the countries we serve; paid express shipping is available as an option. The methods and prices for your country are shown before payment. Orders ship from France, or from our US stock for some American orders, on the same day for orders placed before 12 noon (Paris time) on a business day, otherwise on the next business day. Estimated delivery times by country are given in our Shipping Policy and on each product page.
Except for pre-orders, we commit to delivering no later than 30 days after your order. Failing that, you may ask us by email to deliver within a reasonable additional period; if delivery does not take place within that period, you may cancel the order and be refunded within 14 days.
The risk of loss or damage passes to you when you, or a person you designate, take physical possession of the parcel. If your parcel arrives damaged or incomplete, please write to us with a few photos as soon as possible: this helps us handle the claim with the carrier, without reducing your rights. A parcel lost by the carrier will be resent or refunded.
Article 8. Right of withdrawal
You have 14 days to withdraw from the contract, without giving any reason. This period starts on the day you receive the product (or the last product, if your order arrives in several parcels).
To exercise this right, you may:
- use the “Withdraw from contract here” function, available in your customer account or on your order status page (link in your confirmation email, no account needed);
- send us the withdrawal form in the appendix at hello@gauvainparis.com;
- send us any other clear statement, by email or by post to the address in Article 1.
We acknowledge receipt of your request without delay, by email.
You must send the product back to us no later than 14 days after informing us of your decision, following the procedure described in our Returns and Exchanges Policy. Return costs are paid by Gauvain Paris, whatever the delivery country: we send you a prepaid return label.
We refund all sums paid no later than 14 days after being informed of your decision. We may withhold the refund until we have received the product or you have supplied proof of shipment, whichever is earlier. The refund is made using the payment method used for the order, unless you agree otherwise, and at no cost to you.
You may try the product on as you would in a shop. You may be liable for any loss in value resulting from other handling (product worn, washed, damaged or perfumed): in that case we may deduct an amount matching that loss in value from the refund.
The right of withdrawal does not apply to products made to your specifications or clearly personalised (for example a made-to-measure embroidery).
Article 9. Returns and exchanges within 30 days
In addition to the right of withdrawal, Gauvain Paris accepts returns and exchanges for 30 days from receipt of your order, for items that are unworn, unwashed and with their tags attached. Returns and size exchanges are free, in every country. The details are set out in our Returns and Exchanges Policy. This commercial guarantee is in addition to your statutory rights and does not reduce them.
Article 10. Legal guarantees
All our products benefit from the legal guarantee of conformity (Articles L. 217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). To use it, write to hello@gauvainparis.com with your order number and a photo of the defect: return costs are then paid by us.
The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a price reduction while keeping the goods, or end the contract and obtain a full refund in exchange for returning the goods, if: 1. the seller refuses to repair or replace the goods; 2. repair or replacement takes place after thirty days; 3. repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods; 4. the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights above result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or a full refund in exchange for returning the goods.
Article 11. Liability
We cannot be held liable for non-performance caused by force majeure within the meaning of Article 1218 of the French Civil Code, or for damage resulting from use or care of the product that does not follow its instructions.
Article 12. Intellectual property
The Gauvain Paris brand, the puffin logo, and the photos, texts and visuals on the Site are protected. Any reproduction without our written permission is prohibited.
Article 13. Personal data
The data collected when you order is needed to process it. How it is used and your rights are described in our Privacy Policy.
Article 14. Complaints and mediation
For any complaint, write to hello@gauvainparis.com: we reply within 2 business days.
If your written complaint has not been resolved, you may refer it free of charge to the consumer mediator we are registered with, within one year of that complaint: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, online at www.cm2c.net (section “Comment nous saisir”).
Article 15. Governing law and disputes
These Terms are governed by French law. This choice does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence. In the event of a dispute, you may bring proceedings before the court of your place of residence or any other court with jurisdiction under the law.
Appendix. Withdrawal form
Complete and return this form only if you wish to withdraw from the contract.
